Staying healthy away from home #Mamavation

Trying to stay on track with my weight loss is going to be some what of a challenge this coming week. The day after tomorrow, I leave for the Big Apple, to join 4,500 bloggers at BlogHer.

For me, one of the easiest ways to stay on track is routine at home. When you?re traveling, that routine can easily be ruined. Especially when you are g0-go-go, pretty much the entire day.

The upside to traveling to New York this week, I will be doing a TON of walking. Between the airports, events, parties, and hopefully a little sight seeing.

My goals for this week are -

  • Bring snacks for the plane and while there. Snacks include: fruit, Larabars, nuts, and a refillable water bottle.
  • Avoid ?snacking? at BlogHer events and parties.
  • No food after 8pm, except maybe CheeseBurgHer ;)
  • Get to bed by 11pm, each night.

Last week, I didn?t have a chance to post. Mainly because we were out of town all weekend, and nothing really changed. This week, my weight is about the same. I only made it to the gym once in the past week and a half. We have just been so busy. Once I get back, I am going to get back into my routine, hopefully!

New home for UBC Rugby ? UBC Public Affairs

Athletes and fans will enjoy the new home of University of British Columbia rugby teams at the $2.5 million Gerald McGavin Rugby Pavilion, announced today by Department of Athletics and Recreation and set to open in October 2012.

Located near West 16th and East Mall on UBC?s Point Grey campus and overlooking the Arthur Lord and Frank Buck fields, the Pavilion will feature change rooms, offices, storage space, and bleacher seating for 300 spectators.

The Gerald McGavin Rugby Pavilion will benefit rugby, high performance sport and social life on campus with the addition of a much-needed clubhouse lounge for alumni, students and sport groups.

?Having this facility will showcase our sport,? says UBC men?s rugby general manager Spence McTavish.? ?More importantly, it will bring alumni and rugby fans together.?

The facility is named in honour of UBC Commerce alumnus (?60) Gerald McGavin, a member of the BC Rugby Hall of Fame who generously donated $800,000 towards the project.

?Some of my fondest memories from my athletic career come from playing rugby,? says McGavin.? ?I learned what it takes to work as a team, the value of sportsmanship, and at the same time, I forged relationships that lasted a lifetime.?This facility is the opportunity for the next generation of rugby players to do the same.?

The UBC Thunderbirds women?s rugby team kicks off its season on September 21, 2012 at UBC?s Wolfson Field. The men?s rugby season begins September 15, 2012.

Gerald McGavin is the Director and President of McGavin Properties Ltd., a Member of the Order of Canada, a Fellow of the Institute of Chartered Accountants and the Trust Companies Institute of Canada.? He has received the Montblanc de la Culture Arts Patronage Award for Canada, the Lifetime Achievement Award from the Institute of Chartered Accountants of BC, and the Queen?s Golden Jubilee Medal.

Initial financial and organizational leadership for the project is being provided by former UBC rugby players Peter Bull, Andrew Hamilton, Greg Obertas, Keith Spencer, Peter R. Mortifee, Donald Carson and family, Rob McCarthy and Andrew Bibby.

Funding for the Gerald McGavin Rugby Pavillion includes:

  • $1.6 million from private donors as part of UBC?s start an evolution campaign*
  • $700,000 from UBC Athletics & Recreation
  • $200,000 from the British Columbia Rugby Union as part of a 10-year partnership with UBC.

As an important community partner, the British Columbia Rugby Union will have access to the new pavilion and UBC fields for its youth, developmental, grassroots and high performance programs.

Canada speeds to the podium with 'electrifying' start to the Games

LONDON ? The last time Mark Tewksbury looked just like that ? face bright with a ----eating grin all over it, huge head apparently close to combustion ? he?d won a gold medal.

That was on a grand day in the 100-metre backstroke at Barcelona in 1992. He was all of 24.

Now two decades older and in his first Olympics as the chef de mission for Team Canada, he was at the Aquatics Centre here Sunday when synchro divers Emilie Heymans and Jennifer Abel won a bronze for Canada?s first medal of these Games.

And in the Quebec pair the ecstatic Tewksbury saw a little bit of history being made, a tantalizing glimpse of the future and a huge psychological boost for the rest of the squad.

?Do you see me?? he asked. ?I?m electrified!?

He sure looked all lit up.

?It?s Emilie and Jennifer and amazingly, it?s also the story of our team,? he said.

?We?ve got a four-time medallist [Heymans, the first female diver in the world to win medals at four consecutive Games] with a first-time medallist [Abel, just 20 and very much at the start of her career]. It?s what I hoped would happen: It?s a young team coming together with veterans, and the energy that can be created can be magical.?

A couple of things make the medal special ? that Abel is the third partner with whom Heymans has made it to the podium, which speaks to her adaptability and generosity as an athlete; that it?s a brilliant cap (though Heymans, and Abel, still have the individual version of the three-metre springboard to do and may not be finished yet) to a remarkable career for the Saint-Lambert native, and that the women won it only on the second day of the Games.

In recent years ? going back as far as Tewksbury?s gold, which came on Day 6, through to Beijing, where no Canadian got to the podium until a day later than that ? the medals have come slowly for Canadian athletes, with the bulk being won in the second week of the Games.

Left alone it may have remained merely a frustrating irritant for athletes, but for journalists, who collectively tend to pick any scab before it even forms, the wait meant that on or about Day 4 or 5, they drag out the old ?Canada chokes? stories ? and that, if nothing else, would genuinely ratchet up the pressure on those whose competitions were later in the schedule.

?Take the pressure off?? one of the writers asked Tewksbury.

?Takes the pressure from you guys off the team,? he snorted in reply.

He?s a chef de mission who has been a world champion, a motivational speaker, and a bingo caller, as the late satirical Canadian rag used to call TV folks. He knows from all sides what happens at the planet?s biggest stage.

Most nights at the athletes? village, the plan is for the Canadians to have an informal gathering to take note of the day?s events, but Sunday, Tewksbury said, would be a little bigger than that.

The bronze is obviously the big news, but, as he pointed out, Sunday was a good day for other Canadians, too.

The women?s gymnastics team qualified for the final for the first time in a non-boycott Olympics ? meaning when all the best athletes are actually there. As Elizabeth Black said afterwards, perhaps by way of explanation for the top-8 finish, ?I love the team so much more than individual [events]. The team is 100 per cent what we do.?

Out at the rowing basin near Windsor Castle, the women?s eights blew out of the starting blocks to win their heat. Other athletes got through qualifying rounds to the semifinals or set national records. As Tewksbury put it, ?There?s lots of good news ? it?s just a different narrative? and it can be team-altering.

He compared the agony of the Heymans-Abel win ? there are five dives ? to a ?shootout for 38 minutes.?

As for Heymans? accomplishment, he put it in magnificent perspective. ?In a sport like diving, the precision and being able to deliver when it counts, not just in one race ? that?s also amazing ? but in an event that has five dives, you?ve got to be really, really focused and not blow it at any point.?

The Canadian team has a number of three-and-four-time Olympians, including the multi-talented Clara Hughes, one of only four athletes to have won medals at both Summer and Winter Games.

She has another event this week, the time trial, and it?s her best one, giving her another shot at becoming only the second athlete in Olympic history to win gold in both Games. Eighty years ago, American Edward Eagan won gold in the four-man bobsleigh to match the one he won 12 years before as a boxer. Once every 80 years or so a stunner like Hughes comes around: That sounds about right.

On a day that turned rainy and cool (but, as the Brits repeat with the same dubious optimism that sees them swimming in the sea at Blackpool in May, with every chance of ?growing brighter?), Hughes finished 32nd in the road race.

?It was epic,? she said afterwards. ?It was awesome. There were so many people on the course. We were wondering if people would come and watch the women?s race, so it was amazing to have so much support in the pouring rain.?

And that?s what she sounds like on a tough day: With old pros like that in the house, what?s a youngster to learn but that electrification is a good thing?

Internet 30-Day Free Scams

Surfing the internet lately, consumers are bombarded with 30-day free offers. Most of the time, this marketing trick is devised to get your credit card number, and charge you for shipping and handling. Other times, you are charged up to $99.99 if you do not cancel after 30 days.

Many companies or products use the 30-day free offer to catch you eye. However, in the cases of many diet supplements, get rich free offers, or miracle medication ? its deals can have you losing a lot more than just a little weight, or curing invisible ailments.

You?ve seen the ads. They?re the latest miracle supplements ? acai berry, resveratrol, colon-cleansers ? all promising to make you feel better, look better, live better, with news reports that seem to back up the claims.

?My wife thought it would help with the weight,? said John Lawless, a scam victim. ?We?re open to trying things ? nutritional supplements, things like that.?

Lawless says the news reports helped sway him and the price was right: 99 cents for a trial offer of resveratrol ultra.

But instead of one bottle, he was sent three, at a price of 99 cents for the first one and more than $87 for each of the other two.

When he called the company, he was told that the trial offer automatically turned into a monthly subscription after 15 days. It was all, the company said, in the fine print.

?Must be very fine print,? said Lawless, who said he felt he had been scammed, ?to put it mildly.?

?The scam is once they have the credit card number they proceed from shipping and handling to monthly orders and billing you month after month,? said Mike Galvin of the Better Business Bureau.

Galvin has received more than 3,000 similar complaints so far this year. ?It?s one complaint after another,? he said.

And for each one, he says, there are many more customers who don?t even bother to register a complaint. The company behind the resveratrol ads, FWM Labs, has an ?F? rating.

?An F is a flag, an F is a failure. An F is the lowest grade that you can possibly have and that should be a sign to the public not to deal with that company,? Galvin said.

The problem is customers don?t know who they?re dealing with. The company has dozens of Web sites but none of them are registered to FWM. Internet security expert Alex Stamos says it?s not how a reputable company would operate.

?I?m guessing it?s a very important part of their business model to stay ahead of the customer complaints and stay ahead of people being able to figure out who they are,? Stamos said.

CBS News tracked down FWM at a warehouse in Hollywood, Fla. where dozens of workers were processing, packing and shipping out pills as fast as the labels would print.

?We have a customer service center,? said Brian Weiss, FWM?s 29-year-old CEO. ?If we have complaints we contact the customer immediately.?

But they spoke to dozens of customers who found it next to impossible to get through to FWM. Many vented their frustrations on online forums like complaintsboard.com, calling FWM?s business a ?fraud? and a ?rip-off.? A Google search for ?FWM? turns up page after page of such complaints.

?We?ve sold to million and a half customers since November,? Weiss said. ?So in the overall picture, the number of complaints seems high, but it?s low when compared to the number of orders we?ve shipped out.?

In fact, FWM is one of the most complained-about companies in the nation. The Florida Attorney General is investigating the company and the Federal Trade Commission is looking into the marketing tactic they ? and companies like them ? use. News organizations including CBS have tried to get FWM and others to stop misusing their reports to sell products.

As for John Lawless, he returned all three bottles of resveratrol ultra unopened. A phone representative told him he?d receive a full refund for the bottles.

FWM did send him a refund ? for a single bottle.

Casey Hampton is, at age 35, the second-oldest Steeler. And at well over 300 pounds and coming off a torn ACL, he may be the slowest Steeler as well. But he insists that it?s not over.

?They?ve been saying that for how long?? Hampton said, via the Associated Press. ?They?ve been saying, ?You?re getting old,? and all that for years, and year in and year out we do our thing. So I don?t see it being any different this year.?

The Steelers aren?t as old as they used to be, with aging veterans James Farrior, Aaron Smith, Chris Hoke and Hines Ward retiring this offseason. Hampton said the Steelers have the right players in place to replace those longtime teammates.

?No question about it, when you?ve been around those guys 10-plus years, it?s definitely different,? Hampton said. ?But that?s part of it. You see guys come and go all the time. Those are definitely special guys, but I think those guys will fill in and do their best to make up for it.?

Hampton is currently on the Physically Unable to Perform list, but he says he?ll be ready to go when he needs to go.

?I don?t have no problem with being on it as long as I need to be,? Hampton said. ?I just want to get it right and be right when I?m out there. I don?t want to be out there hobbling messing around; I wanna be out there ready to go.?

And Hampton thinks the Steelers are ready to go to the postseason again, regardless of anyone saying he?s old and slow.

Teaching with Portals: Why Gaming may have Educational Value ...

If you are a gamer, at least one who is not exclusively tied to consoles, this last week was potentially painful. It was a blissful sort of pain, though, since Steam?s now famous Summer Sale happened. Many gamers flock and buy what would constitute tons of discs worth of entertainment, were it not entirely digitally based. Valve, the company behind Steam, can barely keep up with the server strain, and with good reason. A number of people picked up Portal 2, a game I?m more than familiar with. But the game is starting to pick up, well, a bit of steam within the educational community.

Valve is offering what they are calling ?Teach with Portals,? a free version of Portal 2 and a Portal 2 Puzzle Maker, intended to allow teachers to provide a sort of digital testing ground for a variety of subjects: physics, math, chemistry, game design, language arts, and more. I?ve suggested before that thoughtfully interacting with games could provide a number of benefits, including a shared world and setting to discuss ethical issues. I suspect many students in high school will already be familiar with the game, so finding a way to encourage students to learn while playing something they already enjoy seems like a pretty solid plan. Some of my fondest memories from elementary school include playing Oregon Trail, though I can?t for the life of me remember what lesson I was supposed to learn there, though I suspect it had to do with avoiding dysentery. I did learn quite a bit from the typing game we played, though I can?t remember what the game itself was called.

I find studying literature fascinating, and video games have mostly been lacking in this area. We?ve come a long way since the story line stopped at ?A giant reptile has captured a princess, so the plumber had better go save her? which, I have to admit, sounds more like a mad-lib than perhaps the most famous video game series in history. The realm of role-playing games had better stories, or at least ones that were more involved. But rarely did the writing of games have the wit of the?Portal series, the emotional weight of?the?Mass Effect games, or even the action-movie level of madness of the now yearly installments of Call of Duty.?

But?Portal is not unique for its wit and clever writing. On that Steam sale I mentioned earlier, I picked up?Quantum Conundrum.?It was designed by Kim Swift, the creative director behind?Portal, not to mention working on Half-Life 2, both Left 4 Dead games, and the weirdly titled Fat Princess. It is clear that?Quantum?borrows heavily from Portal?s style: we get rooms of puzzles and a nearly omniscient voice directing us (voiced by none other than John de Lancie). The game is far cuter than its spiritual predecessor, but the wit is all there. There are a number of books lying around with names like ?Henry ^8? and ?Beowatt.? So far the game is a bit more of a platformer than a puzzle game. That is, it takes more raw skill than Portal did, but ends up feeling a bit more like a traditional game.

This recent push of ?smart? games strikes me as mostly a good thing. Of course, we don?t want to encourage our children to become addicted to video games, but recognizing their strengths will aid us in wading through a world that is saturated with digital goods. Even if our schools don?t immediately pick up ?teaching through games,? we can use games to teach those who already play them. Sometimes, you just have to ask the right questions.

6.4-magnitude quake hits Indonesia's Sumatra: USGS

A 6.4-magnitude earthquake struck off the west coast of Indonesia's Sumatra island on Wednesday, sending terrified residents fleeing from homes and buildings.

One man collapsed and died of shock while rushing out of his home, authorities said.

The quake, at a depth of 22 kilometres (14 miles), struck around 07:30 am (0030 GMT), some 34 kilometres northwest of Sinabang, capital of Simeulue -- a small, remote island off Sumatra's west coast, the US Geological Survey (USGS) said.

Residents of Sinabang said violent shaking was felt for about a minute and had caused an electricity blackout.

"People were crying, grabbing their belongings and rushing out of their homes," said an AFP reporter in Sinabang.

"There is no electrical power in some areas and I can see cracks in the walls of homes around me," he said.

"Some people are returning inside their homes, but others are still outside, afraid there may be aftershocks."

National Disaster Agency spokesman Sutopo Purwo Nugroho said one man died while fleeing from his home on the island, which has a population of about 80,000.

"A man on Simeulue died of shock. He had a history of high blood pressure and was rushing out of his home when he collapsed and died," Nugroho said.

Local media and Indonesia's meteorology agency said there were no immediate reports of significant damage or other casualties directly related to the quake.

The agency said the quake occurred in the sea off Simeulue, but did not issue a tsunami warning. It said slight shaking was felt in the city of Banda Aceh, about 360 kilometres from Simeulue.

The Australian Bureau of Meteorology said the Indonesian quake posed no tsunami threat to Australia.

The USGS initially reported a 6.6-magnitude quake, but downgraded the intensity to 6.4 -- the same strength as Indonesia's meteorology agency reported.

Indonesia sits on the Pacific "Ring of Fire" where continental plates collide, causing frequent seismic and volcanic activity.

Apple: Mountain Lion OS X upgrade arrives Wednesday

During their third quarter earnings call, Apple reported solid sales of iPhones and iPads, and announced it would release OS X 10.8 (also?known as Mountain Lion) on?Wednesday. The update brings Facebook integration and several iOS features to the Mac, and will cost $19.99.

The release date was previously only known to be sometime in July. iOS is still coming out "this Fall," according to CEO Tim Cook, who also said they have some new products "in the pipeline."

Mountain Lion includes iMessage and a Notification Center, two popular?iOS features, and a new ubiquitous share button is coming to many applications. New dictation and iCloud features have been added, along with?a mode called PowerNap, which allows newer Macs to receive updates and messages while asleep.

The company sold 26 million iPhones and 17 million iPads this quarter, up significantly from the same time from last year. Some analysts were concerned that the upcoming iPhone 5 would dampen demand for the current model, and others suggested that the most recent revision of the iPad was underwhelming and would not see a major increase in sales. Although they did sell more than the same period last year, the numbers were still below analysts' expectations.

Eligible Macs (2GB of RAM, 8GB of hard drive space, and OS X 10.6.8 or newer) will be able to download the update from the Mac App Store tomorrow. As with the Lion release, there won't be a DVD version of the OS?for sale.?

Colorado shooting: Columbine survivors reach out to help Aurora survivors

Her connections to those wounded in the attack early Friday at an Aurora movie theater was closer than most.

Paralyzed in the 1999 Columbine massacre, the 30-year-old Hochhalter said she can offer a little hope to the victims' loved ones and the survivors. "I would tell them that with time, it does get better. But it never goes away," she said.

Columbine students who survived what in 1999 was the worst school massacre in U.S. history are reliving their own experiences. And they're banding together to try to help. On Facebook and by phone, they are reaching out to people who witnessed the attack.

Young people were victims and witnesses in both the theater shootings and the ones at Columbine. The Columbine survivors want those at the movie theater to know that the road ahead of them won't be easy.

"Similar to the graduating senior class from Columbine, they may soon find themselves surrounded by people who have no clue that they were involved in a traumatic event," Columbine survivor Ben Lausten wrote on a Facebook page for survivors of school shootings.

"Breaking down and crying for no apparent reason (which is perfectly normal!) is harder to do in an office, or a business, or in 'normal' society," he said. "These victims have a challenging path ahead of them."

Another piece of advice: Don't waste time trying to figure out what motivated the shooter or shooters.

"It's a waste of time, and it gives them exactly what they want," said Hochhalter, who was eating lunch as a 17-year-old junior when she was shot on April 20, 1999. Even as the years pass, she said, she's no closer to understanding why Eric Harris and Dylan Klebold shot and killed 11 classmates, a teacher, and then themselves.

"I don't think I'll ever understand," Hochhalter said.

But the Columbine survivors understand this: The Aurora survivors will need to talk. And they promise to listen.

"We know what they are going through, and we can help," wrote Michelle Romero Wheeler, a Columbine survivor who posted links to sites supporting people at the theater shooting.

Sunday's Vigil

Among the thousands at Sunday's vigil was Darius Harvey, 18, of Aurora, who was in the theater during the shooting and lost a friend in the massacre.

"I was there and I'm part of this community. I felt I should be here," Harvey said. "It's good for healing the community and I felt that it is very necessary for our state and community to know that our nation cares about us." He then joined the crowd in singing "Amazing Grace."

EU rejects Israeli request to blacklist Hezbollah

The European Union turned down a request Tuesday by Israeli Foreign Minister Avigdor Lieberman to blacklist Hezbollah as a terror group after last week's deadly bombing in Bulgaria.

"There is no consensus for putting Hezbollah on the list of terrorist organisations," said Cypriot Foreign Minister Erato Kozakou-Marcoullis, whose country currently holds the rotating EU presidency.

Israel blames Iran and the Lebanese group Hezbollah for Wednesday's suicide attack at the Black Sea airport of Burgas in which five Israelis and their Bulgarian driver died.

But an EU decision would require the unanimous approval of all its 27 members.

Sitting beside the Cypriot minister at a news conference held after annual EU-Israel talks, Lieberman said: "The time has come to put Hezbollah on the terrorist list of Europe."

"It would give the right signal to the international community and the Israeli people."

But Kozakou-Marcoullis said Hezbollah was an organisation comprising a party as well as an armed wing and was "active in Lebanese politics".

"Taking into account this and other aspects there is no consensus for putting Hezbollah on the list of terrorist organisations," she said.

The EU would consider this if there were tangible evidence of Hezbollah engaging in acts of terror, she added.

Lieberman said Israel was continuing to compile evidence from the Bulgaria attack and would onpass proof to the EU.

But in Israel, Foreign Ministry spokesman Yigal Palmor told AFP that "for years we have been providing Europe with information on Hezbollah's direct involvement in terror attacks.

"But certain states in the EU have clarified to us that because of political reasons, they prefer to not add Hezbollah to the list, despite them not disputing the evidence."

    Not only has The Today Show's replacement of this co-anchor with Savannah Guthrie NOT resulted in a ratings spike, but the program lost to rival Good Morning America by over 300,000 total viewers during Guthrie's debut week behind the desk.

    'For-profit' college students saddled with debt

    When Ashley Wood was looking for colleges, she knew she needed a school that would allow her to work during the day and take classes at night.? She clicked on an ad for the Art Institute of Las Vegas and asked for more information. Within hours, she got a call from an admissions counselor.

    ?Everything they told me was, sounded incredible.? They told me it was the top-notch school, that it had the best accreditation and that I would fit perfectly there.? They really persuaded my mom and I that it was the perfect school for me,? said Wood in an interview airing Thursday, July 19 at 10 p.m.ET/9 p.m. CT on NBC?s Rock Center with Brian Williams.

    The next day, she visited the campus.? She was admitted and attended her first class that night.?Wood, who studied graphic design, said that admissions counselors never asked her for a high school diploma or for a portfolio of her work.? She says the school?s staff helped her apply for financial aid, something she needed to attend school. She initially ended up with $68,000 in student loans. Before she would finish her studies, Wood would take out two additional loans for Art Institute programs abroad. Each loan was $14,000 and covered her tuition, travel and living expenses abroad.? Wood says she chose to study abroad and felt no pressure from the school to do so.

    After graduating, Wood did find a job as a graphic design artist, but paying off?her loans has been more difficult than she imagined. Six years after enrolling, the now 23-year-old Wood has $145,000 in student loan debt with interest rates as high as 12 percent.???

    ?I honestly believe I would have to pay $2,000, $3,000 a month to get ahead on this loan.? If I pay them what they?re asking, my loan literally will never be paid off,? she said.?

    Wood?s story of being saddled with student debt is not unique. Nationwide, student loan debt has ballooned to more than $1 trillion.? It?s a problem so big that it?s drawing scrutiny at colleges across the country, but nowhere has it been as intense as at schools like the one Wood attended, for-profit colleges.?


    For-profit colleges appeal to people because they offer classes both during the day and at night, online and on-campus.? They offer specialized fields of study like culinary arts or fashion design as well as doctorate programs in law and psychology.?? Commercials for the schools tout their successful graduates from business leaders to Pulitzer Prize winners and Top Chef contestants.

    For-profit colleges are a $30 billion a year industry with as much as 90 percent of its revenue coming from student loans and grants, according to the Government Accountability Office (GAO).? They are often backed or owned by publicly traded companies like Goldman Sachs, which owns 40 percent of Education Management Corporation (EDMC), Washington Post Company, owner of Kaplan University, and Apollo Group, owner of the University of Phoenix which has sponsored NBC's Education Nation.

    Controversy has ensued over whether the missions of for-profit schools are to educate or to turn a profit for their shareholders.? The schools say both; critics disagree.

    ?The for-profit schools, because of their business model, target low-income people, because the lower your income, the more Pell Grants you get and the more student loan you?re eligible for,? said Senator Tom Harkin, D-Ia., chairman of the Senate Committee on Health, Education, Labor and Pensions.??So it?s in your business interest to go after those poor students.?

    Senator Harkin, who has spent three years investigating the industry, argues that despite the successes the schools may have had, students at for-profit schools take out more student loans, default more often and have a higher rate of unemployment than students at traditional colleges.? A December 2011 report by the GAO confirmed his findings.???

    Though some colleges dispute the numbers, the Department of Education says that students at for-profit colleges represent about 10 percent of the nation?s college enrollment.? They take out about a quarter of all student loans and grants and of all the students across the country who default on their loans, nearly half come from for-profit colleges.? And when students default, it is taxpayers who pick up the tab.

    Some for-profit executives, as well as an industry trade group, acknowledge that their students are more likely to default, but they say?it?s because their schools serve a low-income population that is underserved by traditional colleges.? They also say that many students over-borrow by taking out loans to cover things beyond their tuition. For example, students will take loans out to cover their living expenses. That is money that the schools never see.?

    In an interview with Rock Center, Bonnie Campbell, a spokesperson for EDMC, the second-largest company in the for-profit industry and owner of the Art Institute Wood attended, defended the company and the industry against criticism regarding its student population.??Campbell is a former attorney general for the state of Iowa and a former member of the state?s?board of regents that oversees its education system.

    She said, ?Do you think it?s appropriate to take a huge block of low-income people and ignore them, say to them, ?Your dream to get an education and a good job really isn?t important to anybody?? It is.??

    EDMC officials say the schools provide financial aid counseling to try to keep students from borrowing more money than they need for tuition and other school-related expenses, but it is the students who are ultimately responsible for determining the amount of funds they wish to borrow.? The company says that regulations prohibit them from doing anything to control or prevent this over-borrowing.? EDMC and others in the for-profit industry say they are advocating to change those regulations.

    Campbell went on to say that 82 percent of EDMC graduates find jobs in their field and giving students a good education is in the company?s best interest.

    ?If you're not educating students properly, if you're not placing them in jobs, you won't make a profit,? Campbell said.?

    But some former recruiters for EDMC and its schools paint a picture of a school consumed less by student success and more by profit.

    ?The students are just a conduit for federal money,? said Suzanne Lawrence, a former recruiter for EDMC.

    Lawrence recruited students for six months and said that her job was to sign up as many students as possible and send them directly to the financial aid office. ?

    ?They?re simply siphoning money from the taxpayers and from the federal government, siphoning them through these students and on the way ruining these students? credit, ruining their lives and filtering that money straight into their stockholders? pockets,? Lawrence said. ?

    Kathleen Bittel, another former recruiter at EDMC, said she too was told to boost the bottom line by recruiting students, regardless of their qualifications.? She says she felt like a telemarketer when she worked for the company.

    ?We called and called and called?phone numbers all day long, hoping for someone to pick up the phone and talk with us,? she said.?

    EDMC is currently the subject of an $11 billion false claims act lawsuit by the Department of Justice along with eleven states. The suit alleges that, from 2003 to 2009, EDMC paid its recruiters solely on a per student basis, which was in violation of the Safe Harbor regulation.

    "Paying people a salary is legal", said Eric Jaso, a former deputy general counsel for the Department of Education who helped draft the Safe Harbor regulation that is the center of the lawsuit. "You can adjust a salary for different factors, quality of work. You can promote people. However, you cannot adjust that salary solely on the basis of how many people they recruit."

    Paying recruiters solely on a per-student basis is an allegation EDMC strongly denies. ?

    ?At all times now and then, EDMC was in compliance,? Campbell said. She says that there are other quality factors that determine a recruiters pay ? including professionalism and work ethic - and?that the former recruiters we spoke with were not in a position to know how compensation was ultimately determined.

    "Literally impossible to determine someone's compensation without a consideration of those factors," Campbell said. She added that the $11 billion figure, which the government says represents the amount of federal funds EDMC obtained from 2003 ? 2009, is patently absurd and was put in the lawsuit for the headline.

    Jaso says that for-profit colleges do provide a valuable service to low-income students, but he fears that, in some cases, greed triumphs over good.

    "When you pay people on a commission basis to recruit students, bad things happen,? Jaso said. "Students are unqualified. They don't stay in school, they don't graduate. They don't get good jobs. They don't pay back their student loans, and the taxpayer suffers. That's what this is all about."

    This is not the first lawsuit brought against the industry for allegedly paying recruiters solely on a per-student basis. One of the largest lawsuits was against University of Phoenix owner, Apollo Group. In 2009, Apollo settled the case for $78.5 million, but did not admit any wrongdoing.

    As for the EDMC case, U.S. District Court Judge Terrence McVerry called it "massive and complex." He said, in a recent ruling, that the company?s compensation plan was legal as written, and it is ?certainly possible? that EDMC complied with all government regulations. Nevertheless, the question remains as to whether it was in fact illegal as implemented. ?EDMC vigorously contests the lawsuit, which is pending in the U.S. District Court in Pittsburgh, Penn.

    Most social media users aren?t bad guys, but disagreement on behavior and expectations can make the Internet feel like the wild wild west, with inadvertent ?ramblers? who tweet the wrong tweet or ?gamblers? who ignore the legal consequences of a promotion.

    Moreover traditional legal perspectives are struggling to keep up with nascent social media behavior and technological advances.? I can say for analytics the concerns of Do Not Track has forced many advertisers to consider actions to address current legislation that can easily misconstrue analysis intent.

    A legal expert has now captured the best of legal interpretations of social media. ?Navigating Social Media Legal Risks: Safeguarding Your Business, by Robert McHale, ESQ ?(@rmchalelaw) with Eric Garulay, will keep you from becoming the social media ?gambler.? ?The book examines how social media behavior is shaping the legal world, and what your business should do to protect itself.

I requested a review copy from the publisher Pearson when I saw a flier at a Barnes and Noble.?     Putting Legal Language on Everyone?s Social Tongue

    McHale?s approach in Navigating works because he operated outside of the advertising world, an environment that has been hyper-stimulated with new tools and applications at every turn.? The book offers 12 chapters on varied business uses of social media (all with U.S. interpretation of the law). Each chapter can stand alone for a quick reference and contains easy language that avoids getting too specific while never talking down the reader

    The result is an actionable book. ?A good fit for the cautious small business owner willing to jump into social media waters but desiring to know what Internet seas contain potentially rough waves from a legal perspective. You?ll learn the cases and interpretations surrounding policies such as the Digital Millennium Copyright Act and the Children?s Online Privacy Protect Act, with useful notes and insights abound in each chapter.

    The key chapters which small business owners will find particularly useful revolve around advertising and employee conduct:

    • Social Media Promotion Law: Contests and Sweepstakes

    According to McHale, people use the words sweepstakes and contest interchangeably, but there is a difference. McHale explains that difference, and potential result from implying an ongoing promotion.

    There?s not a deep examination of Do Not Track ? the debates center on technical uses of browsers ? but Chapter 7?s coverage of Social Advertising reminds one of the range of the FTC. ?CAN-SPAM and the specter of personal identifiable information is explained. You?ll have a better discussion with an analytics specialist when examining the impact of tags and analytic solutions.

    McHale does an excellent job to enlighten overlooked details without scaring you away from social media. The thoroughness is superb, including notes from cases and a thoughtful do/don?t chart in the chapters.

    We learn so much from one another online, but sometimes forget to ask about real world safeguards when it comes to creating online activity such as sweepstakes and establishing internet communities.

    After reading Navigating Social Media Legal Risks, you?ll come away with a more pragmatic view of how to work with people on the Web.? It?ll be a terrific view, because you?ll be well equipped to form solid questions that need answers ? answers that make a good idea a great one.
