Facebook stock up on Zuckerberg's no-sale pledge

NEW YORK (AP) ? Facebook's stock increased nearly 5 percent on Wednesday following a disclosure that its CEO, Mark Zuckerberg, won't sell stock in the company for at least a year.

Zuckerberg holds about 504 million shares and options and had been eligible to start selling them in November. The company currently has about 692 million shares eligible for sale. The concern is that if Zuckerberg floods the market with additional shares, prices would go down further.

The stock is still trading at less than half of the $38 that it went for in Facebook's May initial public offering. It gained 85 cents, or 4.8 percent, to close at $18.58. That more than wiped out Tuesday's loss, during which the stock hit an all-time low of $17.55. It had closed at $17.73.

Since the IPO, Facebook's stock has been down on 45 trading days, up on 29 and unchanged on two.

Facebook revealed Zuckerberg's commitment in a regulatory filing late Tuesday. It also said that two of its board members, Marc Andreessen and Donald Graham, have no "present intention" to sell stock beyond what they need to cover taxes.

Even without Zuckerberg's share, up to 1.2 billion more shares could enter the market over the next several months, including those from employees eligible to sell on Oct. 29.

Investors have been concerned about Facebook's ability to keep increasing revenue and make money from its growing mobile audience.

On Tuesday, Morgan Stanley analyst Scott Devitt cut his target price on the stock to $32 from $38, saying that its mobile advertising revenue is just starting to grow. Morgan Stanley led Facebook's IPO. Devitt still has an "Overweight," or "Buy," rating on Facebook stock.

Doug Anmuth, an analyst at JPMorgan, which was another large underwriter of the offering, also cut his target price on Tuesday, to $30 from $45. He kept an "Overweight" rating as well.

The company, along with the investment banks that led the IPO, is the subject of dozens of shareholder lawsuits. They allege that analysts at the large underwriting investment banks cut their financial forecasts for Facebook just before the IPO and told only a handful of clients. Facebook and the banks overseeing the IPO insist that nothing about its IPO process was illegal or even out of the ordinary.

Clinton seeks Chinese accord on South China Sea

BEIJING (AP) ? U.S. Secretary of State Hillary Rodham Clinton is in Beijing to press Chinese authorities to agree to peacefully resolve disputes with their smaller neighbors over competing territorial claims in the South China Sea. But as she began her meetings here, China questioned the stated neutrality of the United States.

Clinton met late Tuesday with Chinese Foreign Minister Yang Jiechi after arriving in China from Indonesia, where she urged Southeast Asian nations to present a unified front in dealing with China in attempts to ease rising tensions in the South China Sea. Clinton will meet on Wednesday with other top Chinese officials, including President Hu Jintao and State Councillor Dai Bingguo.

The U.S. wants China and the other claimants to adopt a binding code of conduct for the region, along with a process to resolve maritime disputes without coercion, intimidation or the use of force. Clinton wants the Chinese to drop their insistence on settling conflicting claims with individual nations and instead embrace a multilateral mechanism that will give the smaller members of the Association of South East Asian Nations greater clout in negotiations.

She urged all parties to make "meaningful progress" by a November summit of East Asian leaders that President Barack Obama plans to attend in Cambodia..

In Indonesia's capital before heading to China, Clinton offered strong U.S. support for a regionally endorsed plan to ease rising tensions by implementing the code of conduct. Jakarta is the headquarters of ASEAN, and Clinton pressed the group to insist that China agree to deal with them as a bloc.

The stance puts the U.S. squarely at odds with China, which has become more aggressive in pressing its territorial claims with its smaller neighbors and wants the disputes to be resolved with each country, giving it greater leverage.

Clinton made her case in Jakarta on Tuesday in meetings with Indonesian President Susilo Bambang Yudhoyono and ASEAN secretary general Surin Pitsuwan, a day after she delivered the same message to Indonesian Foreign Minister Marty Natalegawa. Indonesia has played a leading role in putting the six-point plan together after ASEAN was unable to reach consensus on the matter in July.

Clinton said the U.S. is "encouraged" by the plan but wants it acted on ? particularly implementation and enforcement of the code of conduct, which has languished since a preliminary framework for it was first agreed upon in 2002. .

"The United States has a national interest, as every country does, in the maintenance of peace and stability, respect for international law, freedom of navigation, unimpeded lawful commerce in the South China Sea," Clinton told reporters at a news conference with Natalegawa.

"The United States does not take a position on competing territorial claims ... but we believe the nations of the region should work collaboratively to resolve disputes without coercion, without intimidation and certainly without the use of force," she said. "That is why we encourage ASEAN and China to make meaningful progress toward finalizing a comprehensive code of conduct in order to establish rules of the road and clear procedures for peacefully addressing disagreements."

Yet China on Tuesday expressed skepticism that the U.S. is neutral in the disputes.

"The U.S. has many times said it does not take a position," Chinese foreign ministry spokesman Hong Lei said on Tuesday. "I hope they will keep their promise and do more to help stability and not the opposite. The South China Sea dispute is a complicated thing. To China, the South China Sea dispute is about the sovereignty of some of the islands there. China, like other countries in the world, has the obligation to safeguard its territories."

China and a host of Southeast Asian countries, including the Philippines, Vietnam and Brunei, have overlapping claims to several small, but potentially energy-rich areas of the South China Sea.

In July, China angered the United States, as well as Vietnam and the Philippines, by creating a city and military garrison on a remote island 220 miles from its southernmost province intended to administer hundreds of thousands of square miles of water where China wants to strengthen its control over disputed islands. China, which also has disputes with Japan in the East China Sea, rejected the criticism.

In addition to the South China Sea, Clinton will be discussing the situation in Syria as well as the efforts to deal with Iran and North Korea's nuclear programs while she is in the Chinese capital.

Clinton is in China at the midpoint of an 11-day, six-nation tour of the Asia-Pacific region that started in the Cook Islands and Indonesia. After she leaves China, she will visit East Timor and Brunei before heading to Russia's Far East to represent the United States at the annual meeting of leaders from the Asia-Pacific Economic Cooperation forum in Vladivostock.

Paralympians Screened for 'Boosting'

Bryan Kirkland could always spot a booster. Sweaty arms, shaky legs and "chicken skin" were telltale signs of the dangerous practice, banned from the Paralympics for its performance-enhancing effects.

"All I could do was shake my head," said Kirkland, 41, a Paralympic gold medalist from Leeds, Ala. "It's so dangerous, and for what: so you can win a race?"

Like blood doping, boosting increases the amount of oxygenated blood circulating in the body. But instead of using blood transfusions and erythropoietin injections, boosters break their toes, block their catheters and crush their scrotums.

"This practice is very unique to individuals with high-level spinal cord injuries," said Dr. Yagesh Bhambhani, professor of rehabilitation medicine at the University of Alberta in Edmonton, Canada, explaining how a spinal cord injury blocks pain signals from the body to the brain. "An able-bodied person would not be able to do this."

Boosting uses self-inflicted injuries to trigger autonomic dysreflexia, a condition that's considered a medical emergency when it happens by accident. Although boosters can't feel the pain, it activates the sympathetic nervous system, causing risky rises in blood pressure.

"If you raise your blood pressure, your heart theoretically pumps more blood. If your heart pumps more blood, you get more oxygen. And if you get more oxygen, your performance is improved," said Bhambhani, author of a 1994 study that found boosting could improve wheelchair race times by nearly 10 percent.

But boosting is dangerous. It was banned at the Paralympics in 2004, "not only because it's performance enhancing, but also because it's a huge health risk," according to Craig Spence of the International Paralympic Committee. "We want athletes to play by rules, play fair, and not risk a heart attack or a stroke for a medal."

Spence said athletes are screened for high blood pressure before certain events, like wheelchair racing. But because autonomic dysreflexia can happen unintentionally -- if an athlete is strapped into a chair too tightly, for example -- boosting is difficult to detect.

"If an athlete generally has high blood pressure and has a medical certificate to prove it, we will allow those athletes to compete. But if an athlete is really tense and doesn't have a certificate -- even it's from autonomic dysreflexia -- then they're banned from competing on the grounds it could lead to a heart attack or a stroke," said Spence.

Kirkland, a quadriplegic wheelchair racer and rugby player, said he has never boosted. But he has experienced autonomic dysreflexia by accident.

"My bladder was full I couldn't get it to empty out," he said, recalling the panic of the sudden surge in blood pressure. "My stomach got really spastic, I got goose bumps -- we call it chicken skin -- and my head started to hurt. I could feel my heart beating in my head."

Kirkland broke his neck in a motocross accident when he was 20 years old, and quickly learned the signs of autonomic dysreflexia, which can be triggered by something as innocent as an ingrown toenail.

"They call it the rookie years of being a person with a disability," he said.

But more than a third of wheelchair athletes at the Beijing Paralympics said they were unaware of the condition, according to a 2010 study by Bhambhani published in the journal Disability and Rehabilitation. One in six athletes ? all males ? said they had boosted at least once to enhance their performance, the study found.

But of the 37 Paralympic athletes screened for boosting in Beijing, none tested positive, according to Spence.

"Boosting is very rare," he said, adding that the "gruesome nature" of the practice makes it a hot topic.

For Kirkland, who is the first Paralympic athlete to be inducted into the Alabama Sports Hall of Fame, the thought of voluntarily inducing a medical emergency is baffling.

"I thought I was going to die when I had my accident," he said. "Why would I want to kill myself now for some boost?"

NDSU players charged with petition fraud

FARGO, N.D. (AP) ? Eight North Dakota State University football players, including four starters, face fraud charges for allegedly forging signatures on two potential ballot measures.

Attorney General Wayne Stenehjem announced the charges Tuesday.

The players were paid $9 an hour to gather signatures to get two citizen initiatives dealing with a state conservation fund and medical marijuana on the ballot. Authorities say many of the petition signatures were copied from phone books or made up.

NDSU football coach Craig Bohl says the players have cooperated with investigators and any team discipline will be decided after they finish legal proceedings. He says the players will be eligible to play this weekend against Colorado State.

The Bison are defending Football Championship Subdivision champions.
